By visiting our Site and/ or purchasing Goods from us, you engage in our “Service” and agree to be bound by the following Terms, including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the Site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
Please read these Terms carefully before accessing or using our Site. If you do not agree to all the Terms of this agreement, then you may not access the Site or use any Services.
Accuracy of Information
We aim to provide information on this Site that is current and accurate. However, we are not responsible if the information made available on this Site is not accurate, complete, current, or free from errors.
We reserve the right to modify the content of this Site at any time, although we are not obligated to. You agree that it is your responsibility to monitor changes to our Site.
If a product provided by us does not match its description, you are legally entitled to return the item to us in its unused state for a full refund or exchange, in accordance with our Returns and Refund Policy.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms at any time without prior notification. Any new content added to the current Site shall also be subject to these Terms. It is your responsibility to check our website periodically for changes. Terms of Sale
Product and Service Availability
All products and services displayed and offered for sale on the Site are subject to availability. These Goods are seasonal and may only be available for purchase during specific periods of the year. Given the perishable nature of some products, we cannot guarantee the availability of any particular item displayed on our Site.
We reserve the right to limit the quantities of Goods available for sale and to remove any item from our offerings without prior notification, for any reason deemed necessary. There may be instances where a product or service remains visible on our Site for a period after it has been withdrawn. We do not assure that any product or service listed on this Site will be available for online purchase.
In the event that a product is not in stock after you have placed your order, we will contact you via email or telephone as soon as possible. You will be given the option to select another available product on the Site as a substitute, or you may opt to cancel your order and receive a full refund, in accordance with our Returns and Refund Policy.
Product and Service Information
We have made every effort to present the Goods on our Site as accurately as possible.
Our objective is to provide photos of our products that accurately represent their colour, size, and shape. However, we cannot guarantee that the actual items will look identical to what is shown in the displayed images.
We aim to ensure that all services provided correspond accurately to their descriptions. However, there may be occasions when the service is customised to meet your particular requirements. We guarantee that any modifications to the service will be implemented solely at your request and only with mutual consent. We retain the authority to decline any requests that fall outside the scope of the service description.
All descriptions and pricing of Goods are subject to change at any time without notice, at the sole discretion of us. If you are dissatisfied with your product or service, you may be eligible for a refund or exchange, in accordance with our Returns and Refund Policy.
Ordering Process
Once selecting your Goods on the Site, they will be added to your online shopping cart. You will then proceed to checkout, at which point you will be required to make payment for your items.
After payment has been received, your order will be confirmed and submitted for processing. Once submitted for processing you may not make any changes to your order. You may cancel your order if we are notified before dispatch on the following day.
Once your order has been dispatched, you will receive a confirmation email with tracking information. This information can be used to monitor the delivery status of your package directly on the carrier's website.
Pricing and Payment
All prices and delivery charges on our Site are in New Zealand dollars (NZD) and are inclusive of the Goods and Services Tax (GST).
We reserve the right to alter prices and delivery charges on our Site at any time without prior notification. We recommend you read these Terms carefully each time you agree to them during the ordering process.
In the case of a pricing error, we are not obliged to honour such price and reserve the right to amend or rectify any errors. If this should happen after you have ordered a product, we will contact you prior to processing your order. Once your order has been processed, the final price shall be those outlined in your order confirmation.
We reserve the right not to accept or cancel your order if the products are not available, are incorrectly priced, or are otherwise incorrectly described. You will be given the option to select another available product on the Site as a substitute, or you may opt to cancel your order and receive a full refund.
We use Stripe as our payment processing service. Stripe accepts payments from Visa credit and debit cards, MasterCard credit and debit cards, and American Express cards. Your order will only be processed once we have verified your payment method and received authorization to process your payment.
All cards are subject to validation checks and authorization by your card issuer. Should we fail to receive the necessary authorization, we will not be liable for any delay or non-delivery. The security of your payment information is a top priority for us, and we utilize the most current security measures to keep your information secure.
Delivery
Products will be delivered to the address specified during the ordering process, provided that it is a registered address in New Zealand. Any address that is not registered will be declined during the ordering process. Purchases made through the Site can only be delivered to a physical street address, and cannot be delivered to a PO Box. If there is a problem with the address you provided, we will contact you before proceeding with the processing of your order to resolve the issue.
Upon completion of your order, you will be notified of the expected delivery charges. Please note that there may be circumstances where the actual delivery charges are higher than anticipated, particularly for large or heavy items or deliveries to rural or remote areas. If the actual delivery fees exceed those anticipated, we will notify you, allowing you the chance to cancel your order prior to processing with a full refund.
We aim to deliver all products within a period of 1-7 business days following the confirmation of your order. Please be aware that this time frame is an estimate and not a guarantee. Delivery may be subject to delays caused by circumstances outside of our control. Should there be a delay, we will notify you as soon as possible, and you will have the option to request a refund.
Once your order has been dispatched, you will receive a confirmation email with tracking information. This information can be used to monitor the delivery status of your package directly on the carrier's website. It is important to be aware that if you have ordered multiple items, they may be packaged and delivered separately.
We will not be liable for any damages, costs, or expenses of any nature that you may suffer or incur as a result of the order not being fulfilled or the products not being delivered within the expected time frame.

Click and Collect
During the checkout process, you will be given the option to collect your order from multiple pick-up locations across the Bay of Plenty.
Due to the perishable nature of some products, you are required to pick up your items on the next designated day of collection (“Collection Day”) following the submission of your order. Each location has a fixed Collection Day of the week within the seasonal period of product availability. If you do not adhere to this requirement, your order will be forfeited and no refunds or exchanges will be permitted, unless an alternative agreement has been reached.
Please be aware that the pick-up days and times may be subject to change throughout the season, but such changes will only occur and be implemented prior to your purchase. You can be assured that your Collection Day will remain unchanged from the time you submit your order.
Upon receiving your order, we will contact you via email to verify your ability to pick up your order on the next scheduled Collection Day. Once pick-up is confirmed, we will proceed with the processing of your order, which will then be delivered to the pick-up location. If you are unable to pick up your order on the scheduled Collection Day, and if we have received notification at least 24 hours in advance, we will cancel the order and issue a full refund.
We will not be liable for damage or loss if you fail to pick up your order on the designated Collection Day. By submitting your click-and-collect order, you agree to these Terms.
When collecting your items, please ensure that you bring your order confirmation email as proof of purchase. You may also choose to have a third party collect your order on your behalf, provided that you have given us prior notice and they can present your order confirmation email.
Should there be any damage, loss, error, or dissatisfaction with your order, you will be entitled to a partial or full refund in accordance with our Returns and Refund Policy.

Transfer of Ownership
We assume responsibility for the products that you have purchased while they are being transported from our distribution location to the address you specified during the ordering process. Upon receipt of the products, it is your obligation to examine them to confirm that they meet your expectations. Ownership and risk of the products will transfer to you upon delivery. You will be deemed to have accepted the Goods unless we receive a written notice of rejection within 5 calendar days after delivery, in accordance with our Returns and Refund Policy.
Returns, Refunds, Exchanges, and Cancellations
In the event that you receive a damaged item or are dissatisfied with a product, you may be entitled to return it for a refund or exchange within 7 days of the purchase, subject to inspection and approval by us.

Severability
Should any provision of these Terms be found to be unlawful, invalid, or unenforceable, that provision shall still be enforceable to the maximum extent allowed by applicable law. The portion deemed unenforceable will be considered severed from these Terms, and such a determination will not impact the validity and enforceability of the remaining provisions.
Termination
These Terms remain in effect until either you or we decide to terminate them. If we, at our sole discretion, conclude that you have failed to adhere to any provision of these Terms, or if we have reasonable grounds to suspect such a breach, we may terminate this agreement at any time without prior notification. You will remain liable for all outstanding amounts up to and including the termination date, and we may restrict or deny you access to our Services. You also have the option to terminate these Terms at any time by discontinuing your use of our Site.
Force Majeure
We shall not be held responsible for any delays or failures in fulfilling our obligations if such delays or failures arise from events or circumstances beyond our reasonable control ("force majeure"). These events may include, but are not limited to, breakdowns of plant or machinery, shortages or lack of raw materials, pest and disease pressures, system malfunctions, transportation strikes or failures, government-imposed restrictions, warfare, labour strikes, or natural disasters.
The fulfilment of our responsibilities under any order you have placed will be considered suspended for the time that the Force Majeure event is in effect. We will make efforts to resolve the force majeure situation or to identify an alternative means by which we can fulfil our commitments. If the delay reaches a length that we consider to be excessive, we retain the right to terminate the contract without facing any liability.
Waiver
Our failure to exercise or enforce any right or provision contained in these Terms does not signify a waiver of that right or provision, nor does it limit our ability to enforce these Terms at a later date.
Governing law
These Terms are governed by and interpreted in accordance with the laws of New Zealand.
